Now, is "blame someone else but me" a distinct Filipino character trait? I'm beginning to think it is! 

For the last few years, the usual refrain when people discuss the Sabah claim issue is to blame the British for the situation the Philippines finds itself in with regard to its stale claim on Sabah. Well, well...

Alright, let's deal with it and throw the Framework Agreement, the BBL, the entire immobile Sabah claim, the Sultanate of Sulu bickering (nearly fratricidal crap, etc, etc) and include with them the kitchen sink at the British. 

I agree the British 'created the problem' as many people who have just recently discovered the North Borneo (Sabah) conundrum have been spewing all over the place.  But here's what: these Filipinos must understand and admit once and for all that the Philippines contributed largely to that decision that created the problem (and continues to contribute unequivocally to the problem TODAY).

But let's be fair and be a bit more clever about things. It's nice to have a punching bag or to have a butt of "sisi" (much like Noynoy aka as Boy Sisi), in this case, the British, but we must ascertain that the Philippines, its leaders and its people aren't at  fault either before we cast blame or "sisi" all around. Anyway, if we want to cast "sisi" all around, here are some real reasons for you to go and do all the "sisi" you want:

(1) At the time, i.e., early 60s, Senator Jovi Salonga was working so hard negotiating with the Brits, your/our own countryman, Senator Lorenzo Sumulong, a flamboyant ex-diplomat to the UN (who happens to be the grand uncle of current PH president, Noynoy Aquino), was going all over the place, attacking and casting vitriolic heaps of acid via the PH Senate pulpit to whip PH Govt and its Sabah claim to extinction. 

He sold the PH claim to Tunku Adul Rahman, then Malaysia's Prime Minister by acting as the soon-to-be-created Malaysia Federation's attack dog against the Government of the Philippines and its claim to Sabah. It wouldn't surprise me therefore, that like the big powers at the time, the Brits took this all-Philippine treasonous approach to the Sabah claim, happening in one of the highest echelons of power, as an excuse to say, "Bloody hell! You people don't know what you want? Well, I'll decide for you!" (Let's not beat around the bush, it was an all-Filipino treason game which must have greatly amused the Brits and the Malayans!) 

(2) Furthermore, if blame has to be cast all around, let's not look far away.... Our own masters and commanders at the time, the great United States of America, did not lift a finger, did not do anything at all to help us convince the British to allow the Sultanate of Sulu to have it back in 1962. On the contrary, the Americans not only did not pay even scant attention to this issue but also discouraged us from tackling the Sabah issue (check out records from as far back as 1957). And one would have thought that as our greatest allies, they would see our way. But heck, no...just didn't happen, but you don't see me around blaming the Americans, now, do you? (Fast forward... In 1967 or 68, it was America that alerted Britain that Marcos was on a "war path" and so what happened? Britain tried to show force by landing fighter aircraft on our own soil. Did America say anything? Nope! Not a word! They were in cahoots with the UK!)

(3) One important element: When Malaya's Tunku Abdul Rahman went to Sabah before the Sabah referendum in 1962 to talk to the elders of North Borneo (Sabah), why did not the Philippines do the same to organise a campaign in situ to get the Sabahans on side? Why?

The Philippine Government was well aware of what was going to happen but did not lift a finger, did not do anything and instead, LEFT EVERYTHING TO FATE as in "Bahala na!" The Government at the time just sat on its big fat ass while the other party, the Malayans led by Prime Minister Tunku Abdul Rahman, were going at things hammer and tong right in the heart of Sabah to convince the Sabahans to join the soon-to-be created Malaysia Federation. TOTAL PHILIPPINE INERTIA! PH Govt just didn't go the extra mile even if it meant saving Sabah claim's own skin for God and country. Parbleu! And you think we are not to blame?

And I can recite a long series of other "blames" but I won't. I'll stop at those because they should be enough to enlighten you.

So, lets be a bit more clever about this, shall we? Because we can't just be making "sisi" all around like Noynoy does today when things go wrong and believe that it's everybody else's fault but ours! If you really want to know, we were as much to blame for being generally do-lally about the claim. 

This "sisi" doctrine seems to be deeply embedded in our psyche but let's get over it and move on!

Let's not allow classic INERTIA (Bahala na!) to overcome us just because it makes us feel better to  whine consistently and to look back to the past to blame the British for all that has gone badly with Sabah (of which, I must remind Filipinos, are also largely, hugely responsible for, anyway) and let this politics of blame stop at the water's edge! Instead, FIND SOLUTIONS TO HOW TO GET THE BLASTED SABAH BACK or at the very least, find solutions not to allow this country to be partitioned by radicals, zealots, fanatics, secessionists, Malaysian warriors by proxy in the southern Philippines with the treasonous complicity -- again of Govt officials, elected and appointed!

Blaming the Brits for the Sabah debacle ad vitam eternam is not going to help achieve what many Filipinos want, i.e., get Sabah back.

UPDATE 4 - 9:14 a.m.) MANILA, Philippines - Sulu Sultan Jamalul Kiram III passed away Sunday morning at the Philippine Heart Center (PHC) in Quezon City, the sultan's daughter Princess Jacel Kiram, told dzMM radio. 

Kiram, who fought to reclaim Sabah from Malaysia, died at 4:42 a.m. He was 75. 

He was supposed to undergo dialysis but his blood pressure dropped drastically prompting his family to rush the sultan to the PHC where he died due to multiple organ failure, according to Princess Jacel. 

"Iniwanan n'ya tayo [He left us] with something to move on. We have to continue fighting for the Filipino people," his daughter said. 

"Ang gusto n'ya tayo na lang ho ang magpatuloy for the Sabah case [What he wants is for us to pursue the Sabah case]," added Kiram's daughter. 

Princess Jacel said that before he died, her father said that, "You have to be strong dahil meron pa tayong misyon sa buhay. Kailangang maibalik kung ano ang dapat na maibalik sa atin You have to be strong because we still have a mission in life. What needs to be returned should be returned to us] ."  

She said Kiram also always told his family that, "Everything happens because the Almighty allowed it to happen." 

Kiram's remains were brought to his residence at Maharlika Village in Taguig City. 

Princess Jacel said their family would like to bury the sultan in Maimbung, Sulu within 24 hours. 

In February this year,  Kiram sent about 400 of his followers to Tanduao village in Sabah's remote coastal town of Lahad Datu to reclaim the territory. 

Kiram said he was prompted to send his people to Sabah after the Philippine government left them out of the framework agreement signed in October, which only catered to the interest of the Moro Islamic Liberation Front (MILF).

It was Malaysia, which took over Sabah in 1963, that brokered the peace talks between the Philippine government and the MILF. 

While the MILF respects the Kiram family's claim to Sabah and won't stand in the way of that claim, it "will not revive the claim," according to Khaled Musa, deputy chairperson of the MILF's committee on information.   

Kiram, who ran but lost in the 2007 senatorial elections, was the acknowledged leader of the Sultanate of Sulu and North Borneo. The sultanate based in Southern Philippines once controlled North Borneo, which is now known as Sabah.   

The sultanate acquired Sabah as a prize for helping the Sultan of Brunei against his enemies.

According to the sultante, it did not relinquish its sovereignty over Sabah and only leased the territory to the Briitish North Borneo Company starting in 1878.

Pajak, the keyword in the 1878 pact

The keyword in the 1878 agreement between the Kiram family and Gustavo von de Overbeck of the Briitish North Borneo Company was pajak. The Kirams maintain that pajak means lease. But Malaysian authorities define pajak as sale. 

The lease continued until the independence and formation of the Malaysian federation in 1963, which included Sabah.

Because of Sabah's inclusion, the Philippine government during the presidency of Diosdado Macapagal, broke diplomatic relations with Malaysia.

It was during Macapagal's term when then reigning Sultan of Sulu, Muhammad Esmail E. Kiram I, ceded to the Philippine government the full sovereignty, title, and dominion of Sabah to the Republic of the Philippines. This gave the Philippine government the full authority to pursue its claim to Sabah in international courts. 

But starting in 1989, succeeding administrations put the Sabah claim on the back burner and instead decided to pursue economic and security relations with Malaysia.

P70,000 for 7 million hectares 

Up to now, the heirs of the sultanate receive rental money for Sabah from the Malaysian government. 

Sabah’s total land area is 7.36 million hectares or almost one-fourth of the Philippines, which is 30 million hectares.

Annually, the Malaysian government pays the heirs of the Sultanate of Sulu, 5,300 Malaysian ringgit currently equivalent to P70,000. If pajak is defined as rent, it means that Malaysia’s annual rent of Sabah is only .009 centavos per hectare. 

According to Kiram, the rent they receive only proves that the sultante owns Sabah. 

"Why should we leave our own home? In fact, they are paying rent (to us)," Kiram earlier told reporters in Manila. 

"Our followers will stay in Lahad Datu. Nobody will be sent to the Philippines. Sabah is our home," he added.

The Sulu Sultanate on Sunday  said  it is sending more “volunteer” fighters to Sabah from Mindanao to reassert its territorial claim over it and to protect the Filipinos there who are being rounded up by Malaysian police.

Abraham Idjirani, spokesman of Sulu Sultan Jamalul Kiram III, said groups of Bangsa Suluk volunteers were preparing to sail to Sabah and join the 1,600-strong Royal Security Forces of the sultanate led by Kiram’s brother, Raja Muda Agbimuddin Kiram.

“They will be going to Sabah because of the un-Islamic rounding up of innocent civilians by the Malaysian security forces,” Idjirani said from Kiram’s residence in Taguig City.

“They feel it is their patriotic duty to protect their countrymen there and to show the world that Sabah is their homeland.”

Asked how many fighters were sailing to Sabah, Idjirani said they had no idea yet but the fighters would be going there quietly in waves or groups to elude the Malaysian and Philippine naval cordons.

Once in Sabah, they would be consolidating forces and communicating with Agbimuddin, who remains in Sabah since sailing there with 200 men in February.

“They are now driven by their belief that Malaysia does not own Sabah,” Idjirani said.

He said the volunteers would come from Sulu, Tawi-Tawi, Basilan and Zamboanga.

“Our leaders told us that these Bangsa Suluks have been itching to go to Sabah because they are angry over the Malaysians’ treatment of the Filipino residents of Sabah,” Idjirani said.

He said  some of the Sabah-bound volunteers would be armed, with many of them experienced in battle, although they would not be going to Sabah to wage war.

Fraudulent Sulu sultanate claimant Datu Fuad Kiram aims to legitimize sting operation

ATTENTION! TO THE UNIVERSITY OF THE PHILIPPINES:
 
We have just been informed that a group of charlatans headed by Datu Fuad Kiram and aided by his close-in handlers, are working hard, aiming 'hig'h in order to legitimise their sting operation and are exploiting the naivete of a UP student group: the UP Economics Society which is about to sponsor a symposium founded on the fraudulent claim by Datu Fuad Kiram and his handler Omar Kiram (not a Kiram nor a prince of the Tausug) that they are sultan of Sulu and Sabah and 'grand prince' of Sulu respectively.

We fear that the UP Economics Society which we understand is composed of students from the Philippine state university might be unwittingly lending their name to an economic scam by the group of Datu Fuad Kiram. The UP group must be informed. Their ignorance of Sabah claim history is most likely being exploited by said band of con artists.

We suggest that the UP Economics Society not allow the name of the University of the Philippines to be lent to such undertaking by a group of fraudulent sultanate of Sulu claimants.

However, if the UP student group could INVITE ALL THE CLAIMANTS TO THE THRONE TO THE SYMPOSIUM TO TACKLE THE Sulu Sultanate claim and to ask them about their purpose, then fine... Otherwise, the said UP students must exercise due diligence and inquire, get informed and learn about who is who in the Sultanate before they attach their name to a group of objectionable individuals such as Datu Fuad's and his handler's whose only purpose in life it seems is to use the nation's Sabah claim to try to get rich quick.

It is imperative for the members of the UP Economics Society not to risk their credibility as the nation's brightest of the bright students whose education is greatly subsidised by the Filipino taxpayers. One way to do it is to be cautious...extremely cautious that they are not exploited to satisfy the grandiose economic dream of Datu Fuad Kiram and his men for himself and for their band of fraudsters that can and will damage the nation's genuine claim to Sabah.

Honouring the UN Treaty, 1963 Manila Accord, is the only way forward to solve the Sabah question

ON 31st JULY 2013 IS THE 50TH ANNIVERSARY OF THE MANILA ACCORD*

THE ONLY LEGAL SOLUTION TO THE SABAH QUESTION IS TO HONOUR THE MANILA ACCORD. How? By pressuring Kuala Lumpur to negotiate with the Philippines. However, there is no way in hell that it can happen if President Aquino has put it in his head not to face the question head on or even just to raise - with a gentle whisper - the Manila Accord with his great friend in Kuala Lumpur, the not-so-smart (but one who has outsmarted our benighted leader Noynoy at every turn), the one and only corrupt, the greedy Bumiputra Affirmative Action-BN leader, ta da da... Najib Razak, the son of the man who initiated the troubles in Mindanao and caused the Philippines to lose many of its sons and daughters in what was then called the Mindanao Secession Wars...

Most of the 20 million Malayans are not that smart, in fact, they are rather stupid, are terribly bone idle, but one wonders how on earth they manage to outwit and outsmart 100 million Filipinos, many of whom boast of a certain degree of sophistication be it in education or in general culture!

The other solution is for Sabah to withdraw from the UK-engineered Malaysia Federation. There seems to be a trend towards that today but will all of Sabah agree? Not sure - Sabahans are just like Filipinos, they are easily conned by nice words, by good bribes and fight each other most of the time. They are rather laid back (understatement) so will take a bit of push from somewhere.

The ultimate solution, one might say, is war. But according to our benighted leader, that's out of the question and we agree with him. We not only do not have the material capability to go to war with Kuala Lumpur, it is also almost a certainty that most of our people will be anti such move. We have seen how PH reacted to the 'excursion' headed by SJKIII's brother - many of our politicians and their supporters almost peed in their pants when the Lahad Datu stand off happened... So let's say, that war is not an option.

If only we didn't have the Kiram 'intramurals' (the bickering, the infighting, the 'faking' - usurping of sultan title, etc, etc.,) perhaps, things would be slightly different. The saying that "united we stand divided we fall' is, as always, true.

NB: *Section 12 of the Manila Accord - UN TREATY 8029, signed by three heads of states before the creation of the Malaysia Federation namely, Suharto of Indonesia, Rahman of Malaya and Macapagal of the Philippines, stipulates the following:

12. The Philippines made it clear that its position on the inclusion of North Borneo in the Federation of Malaysia is subject to the final outcome of the Philippine claim to North Borneo. The Ministers took note of the Philippine claim and the right of the Philippines to continue to pursue it in accordance with international law and the principle of the pacific settlement of disputes. They agreed that the inclusion of North Borneo in the Federation of Malaysia would not prejudice either the claim or any right thereunder. Moreover, in the context of their close association, the three countries agreed to exert their best endeavours to bring the claim to a just and expeditious solution by peaceful means, such as negotiation, conciliation, arbitration, or judicial settlement as well as other peaceful means of the parties' own choice, in conformity with the Charter of the United Nations and the Bandung Declaration.

LET THE TRUTH BE TOLD: DATU FUAD 'HUWAD' KIRAM IS NOT A SULTAN AND CANNOT BE SULTAN OF SULU!

DATU FUAD 'HUWAD' KIRAM IS NOT A SULTAN! His handler, Omar 'FAKE' Kiram is a manipulator of truth and uses propaganda for self-gain. 

THE REAL SULTAN OF SULU IS NOT ON FACEBOOK unlike this FAKE duo who only exist on Facebook. He is an IMPOSTOR OR FAKE perpetuated by his handler who is also posing as a Grand Prince Marshal and changed his name to Omar Kiram and who does not have a single drop of Kiram blood running through his veins. OMAR KIRAM IS A CON-ARTIST AND AN IMPOSTOR! 

He used to be called as Dux de Legazpi which is also a fake name. He went by many aliases to defraud people. I was one of their supporters in the past until I discovered their fakery. I confronted Omar with some questions but since he knows he is FAKE he could not sustain our argument, so he retreated. 

I was conferred a Lady Master title albeit FAKE that I rejected and returned to them. Omar then put me in their FAKE Royal kangaroo court and gave me a persona non grata verdict, as if I care! I fought back by spending my own resources to uncover and research for the truth about the Sultanate of Sulu. Since then, Omar has sent his attack dogs after me to attack me personally to take my focus away from him and Fuad. But they have FAILED because I am armed with the SWORD OF TRUTH. I CAN TAKE THEM ALL AT THE SAME TIME FOR I AM ON THE SIDE OF TRUTH! 

I challenged them to sue me so we would know who is who and so I can unmask the real identity of Omar "FAKE" Kiram. That was two years ago. Understandably so, Omar does not want a real appearance in any court because then he will go to jail for his misdeeds. The Fake Sultan Fuad and Grand Prince Marshal Omar "FAKE" Kiram only existed on Facebook and those who support them are either unsuspecting followers or a bunch of KSPs who have delusion for grandeur we call Farmvillers.

Furthermore, even if we take into consideration Fuad and Omar's lame use of Law of Primogeniture which is not what the Sulu Sultanate goes by, FUAD STILL IS NOT GOING TO BE THE SULTAN. The law passes on to the FIRST BORN which Fuad is NOT. Sultan Ismael's first born son is Mahakuttah, elder brother of Fuad. And Mahakuttah's eldest son is Muedzul-lail. This is another story where Omar and Fuad stole Fuad's nephew, Muedzul-lail or Butch's right from him. 

The Sulu Sultanate's Royal succession is pre-determined by the Ruma Bichara or the Royal Council and NOT the law of primogeniture. BEFORE ONE CAN BECOME SULTAN, ONE HAS TO BE CHOSEN FIRST AS THE RAJA MUDA OR CROWN PRINCE and not necessarily a son but one chosen by the Sultan and the Ruma Bichara. When the Sultan dies, the Raja Muda is then proclaimed Sultan by the Ruma Bichara and chooses his own Raja Muda. 

Sultan Esmael's (Mahakuttah and Fuad's father) Raja Muda was his own brother: Datu Punjungan,  father of Jamalul, Ismail, Agbimuddin, Nasser, etc. So when Sultan Esmail died, Punjungan was in Sabah at that time, Jamalul was declared the interim Sultan by the Ruma Bichara headed by Princess Tarhata and the Royal heirs. When Punjungan returned from Sabah in 1980, he was formally proclaimed as Sultan by the Ruma Bichara in a public ceremony in Sulu. Sultan Punjungan's Raja Muda was also proclaimed -- and that was Jamalul, who succeeded as Sultan of Sulu when Punjungan died.

Datu Fuad 'Huwad' Kiram, the cousin of Jamalul Kiram III, proclaimed himself Sultan in a basketball court in Taguig with no Royal dignitary present. He then declared Omar whom he met in 2004 as a Grand Prince Marshal. These IMPOSTORS are using royal-sounding titles to defraud people. Fuad is destitute and Omar pays for his rent so he went along with this charade because of money making scams by Omar, the Master Puppeteer. 

According to Fuad's third wife Farida who he left while pregnant, Omar sold Datuk title to foreigners and other scams he does for money using a FAKE Royal title. Fuad had signed the settlement to sell off Sabah to Malaysia. The only signature that is missing in that settlement is Sultan Jamalul Kiram III, thus, preventing Malaysia from legally owning Sabah. This started during the Cory administration up to Ramos administration. They thought that since Ramos and Jamalul are compadres, Ramos will be able to convince Jamalul into signing the settlement offered by Malaysia. 

But Jamalul was and still is steadfast in his refusal to sell off Sabah because he said, "HONOR IS MORE IMPORTANT THAN MONEY. I WANT SABAH BACK FOR MY PEOPLE!" Fuad on the other hand had sold his family out to Omar and until now still continues to create division among the Kiram family. I wouldn't doubt it a bit that Fuad and Omar are paid off by Malaysia to hinder the Sultanate's reclamation of Sabah. Check out some of the proof attached to the link below. Fake sultan's only real royal and legal title in reality is 'datu': Datu Fuad A. Kiram

FUAD KIRAM SIGNED THE 'UNITY' AGREEMENT WITH HIS REAL TITLE, DATU!

The recent Sabah stand-off brought out some truth that many of us did not know or expect. First, we did not know the relation between the Cojuangcos (PNOY's family) and Malaysia dating back to the time of then Senator Ninoy Aquino (PNOY's father). Then we discovered to our dismay that our president would rather go back on his sworn duty to protect this country and its people just to protect his KKK's business interests and to protect his parents' legacy, right or wrong. 

It is disheartening to know that our president stands by while our people are being hunted down, tortured and killed for asserting their lawful right. Listening to our president colluding with the enemy and echoing Malaysia's Razak Najib's sentiments are not only disheartening but also disconcerting. Added to the Sulu Sultanate's dilemma is the disunity of the Kiram heirs. 

One of them, the infamous Datu Fuad has been defrauding people in and out of Facebook under the wing of his Con-Artist handler, the Master Puppeteer, Omar "FAKE" Kiram who is not even a Muslim by birth but who is an Ilonggo and is never a Kiram. Omar is peddler of FAKE or knock-off designer bags and accessories who met Datu Fuad by chance. Being a Con-Artist, Omar saw an opportunity for a money-making scheme using a Royal title albeit FAKE. Read the attached file I previously wrote with compelling proof to back up my claim. 

Fast forward to the recent development brought on by the stand-off. The Kiram heirs decided to unite and rally behind the REAL Sultan of Sulu who was proclaimed Sultan by the Ruma Bechara in a public ceremony in Sulu unlike the UNDIGNIFIED self-proclamation of Datu Fuad in a basketball court in Taguig. Sultan Mohammad Jamalul Kiram III (SJK) is the only one recognized as the true Sultan by both the Philippine and Malaysian government when Malaysia first attempted to buy off Sabah from the Sulu Sultanate during the administration of Pres. Cory Aquino and then Pres. Fidel Ramos up to the administration of Pres Gloria Macapagal-Arroyo. 

The administration of PNOY may not recognize SJK because he claimed ignorance of the issue at pinag-aaralan pa daw niya. I wonder why Sec. Lila De Lima's findings of the Sultanate were not even posted. Could it be that it only proves the Sulu Sultanate's case and it is a humiliating truth for PNOY? The rest of the Kiram heirs have signed that settlement agreement to drop the claim on Sabah EXCEPT for Sultan Jamalul who could not with his heart and soul, sell the legacy of his people. He declined the money and this is where we are now. 

The attached document showed that Datu Fuad signed with his TRUE AND ONLY legal Royal title and that is as a DATU. FUAD ALSO ASKED THE HEIRS FOR MONEY BECAUSE ACCORDING TO HIM HE IS HEAVILY INDEBTED TO HIS FINANCIERS. Check out his signature and see for yourself. THIS IS NOT A FABRICATION like what his handler Omar has been posting in their fraudulent website where pictures are photo ops (like the ones with Nur Misuari who happened to oblige to a meeting request by Fuad and Omar) and all other documents FABRICATED to defraud people. I will post some more of the documents soon.

Sabah: Kuala Lumpur formulates Medieval Age tactics in the name of Sultan of Terangganu against Sulu Sultanate

The capture of Datu Amirbahar, a royal Kiram (in picture) and the spectre of death penalty against him is Malaysia king's -- and his Kuala Govt's, Medieval Ages  tactic meant as a message to the Sultanate of Sulu: "We will decimate you and we will have your land!"

The Courts of Malaya Federation's Sultan Mizan Zainal Abidin of the Sultanate of Terannganu, have no right to accuse, arrest, detain and tell a royal member of the Sultanate of Sulu, a Suluk (Tausug resident of Sabah) no less, that he is facing the death penalty allegedly "because he is the Sultanate of Sulu's defence minister, for being a member of a terrorist group, and for waging war against the king of Malaysia".

It is the Sultanate of Sulu and North Borneo (Sabah) who should be pressing charges against the king of the Malaya Federation, his Kuala Lumpur Govt and their armies for bringing chaos, death and destruction to Sabah, to the Tausugs, to the Suluks, for waging terror and war against the Sultanate of Sulu and North Borneo (Sabah) and absolutely not the other way around.

It was Malaysia's armies - in the name of the Terangganu Sultanate's Sultan Mizan Zainal Abidin who is currently the Malaya Federation's king, that launched an overkill against 230 men and women in Tanduo and not the other way around. It is Peninsular Malaysia that is illegally occupying Sabah and not the other way around.

This accusation and death penalty arrangement formulated in the name of a foreign sultanate against Datu Amir, son of Sultan Bentalin Esmail Kiram II and nephew of Sultan Jamalul Kiram III, is effectively a message from Kuala Lumpur to the Sultanate of Sulu: "We will decimate you and we will have your land."

With Datu Amir's arrest, detention of and death penalty being danggled against him,' Malaysia is attempting to hold the Sultanate hostage as they perpetuate the medieval form of political action to vanquish the enemy, obtain more land, in order to extend their political, military and economic power beyond their current realm.

And by threatening to kill no less than an immediate member of the current leaders of the Sultanate of Sulu and North Borneo (Sabah), Kuala Lumpur wants the Sultanate of Sulu, its members, heirs and supporters to accept the most abject form of insult from an enemy, i.e., in order to reduce them to begging.

Understand that Kuala Lumpur, the Malaysa Federation and their so-called 'king of Malaysia' will do everything and anything to sap the morale of the Sultanate of Sulu and North Borneo. They are forcing them to surrender rich, very rich Sabah unconditionally and with that happening, they are hoping that the Sultanate of Sulu and its heirs will be gone forever. Truly, the exercise is strangely similar to those practised in the Medieval Ages!

People must hoist it in - must understand - that this latest action by Malaysia is actually a message to all and it is meant to inflict the most savage form of Medieval Age political power vendetta play against the Sultanate of Sulu and North Borneo (Sabah), against the Tausug people, against the Suluks, and by extension, to show their contempt for the Filipino people.

Kuala Lumpur is already aware that the Filipinos of Luzon and Visayas and even some in Mindanao will not do anything because President Aquino has played his role to perfection; his fearmonger strategy has worked, i.e., the Filipinos have effectively 'capitulated.' But Kuala Lumpur wants the Sultanate of Sulu and North Borneo, the Tausugs, the people of the Sulu archipelago, the Suluks and their supporters in Sabah to do the same: to surrender Sabah unconditionally!

Malaysia will try to corrupt every known Filipino in the Philippines, might even bribe members of the MILF to help in the hunt, to lay their hands on an even bigger royal catch: Raja Muda/Crown Prince Datu Agbimuddin Kiram, younger brother of  Jamalul III and Esmail II.... also known as Datu Puing, commander of the Sultanate Army in Sabah.

There is no doubt that  Malaysia king, through his government in Kuala Lumpur, is hoping that the capture of a crown prince will finally legitinise Peninusular Malaysia's illegal 50-year war for the control of Sultanate of Sulu and North Borneo (Sabah) lands.

In an article by Vidal Yudin Weil for the Free Malaysia Today dated March 9, 2013, the writer called Najib to task after Najib's pronouncement in Lahad Datu “The question of Sabah within Malaysia should not be disputed by anyone. Let not anyone underestimate Malaysia’s commitment to have Sabah within Malaysia forever. No one can dispute this, from within and outside the country. We will uphold the principle and fact of Sabah within Malaysia absolutely”.  

The Malaysian writer insisted that Najib was wrong: "Najib is wrong in making unilateral claims that Sabah belongs to Malaysia when historical legal documents and agreements may indicate otherwise."

The writer also enumerated the salient points in that Manila Accord:

•    the inclusion of Sabah into the formation of Malaysia is subject to the Philippines claim; and
•    the Philippines’ claim on Sabah must be settled in the International Court of Justice (ICJ) run by the United Nations.

With implaccable logic, he said: "Therefore, until such time when the ICJ has decided, Malaysia does not have absolute ownership of Sabah."

Police To Check For Terrorist Remains In Kampung Tanduo
 
LAHAD DATU, April 9 (Bernama) -- Periodic checks will be conducted in Kampung Tanduo for the remains of terrorists from the militant group which invaded the village on Feb 12, said Sabah Deputy Police Commissioner Datuk Tan Kok Lian.

He said K9 dog units would be used to detect graves which may contain such remains.

"We will check the area because there may still be some bodies buried in the village," he said after surveying several locations in Kampung Tanduo near here Tuesday.

Police discovered three graves containing 15 bodies, including that of a woman, and removed them from the village yesterday.

Mr. President, there is no shame in standing by the Sultanate, by the Tausugs, by the Filipinos in Sabah... there can only be pride because they are your people too. You can unite the country by standing by your people in time of crisis.

Mr President, every child left orphan because Malaysian troops killed his/her father or both will ask you why you did nothing while foreign toops killed a member/members of his/her family. Even Malaysia knows and accepts that Sabah is leased. They cannot deny it. In fact, Malaysia is still paying rent to the Sultanate heirs.

"Why the government is taking the stance of an un-involved observer is beyond comprehension. When the sovereignty and dominion over the territory was transferred to the Philippine government by the Sultanate in 1962–which the government accepted as shown in its many overt acts–the government took on the responsibility of reclaiming Sabah and protecting Filipinos who initiate non-violent actions to revive the Philippine claim."

In my column last week entitled “Legal basis for the Sabah claim,” I discussed how the Sulu Sultanate came to acquire North Borneo (Sabah) and exercise dominion and sovereignty over it, and how Malaysia  came to possess the territory. 

In this article, questions on what the Philippines has done to make an official claim over Sabah and how Malaysia responded will be discussed, culling from the booklet written by Prof. Emmanuel Q. Yap, founder of the People’s Patriotic Movement. 

When the Sulu Sultanate transferred by a legal instrument its dominion and sovereignty over Sabah to the Philippine government in 1962, did the government do anything to assert its ownership over Sabah? Yes. Even before the Federation of Malaysia came into being, the Philippine government, in 1950, advised the British government that it had a claim over Sabah. Too, the Federation of Malaya (not yet Malaysia) recognized that there was an Aide Memoire dated August 2, 1962 from the Foreign Affairs Department of the Philippines which reminded the Federation of Malaya that “Britain occupies the territory by the terms of the lease which, in no way, entitles the British government to claim ownership or sovereignty over the territory or to transfer it to any entity whatsoever.” 

The Federation of Malaya acknowledged this Aide Memoire by also handing an Aide Memoire to the Philippine Ambassador in Kuala Lumpur on October 3, 1962 stating that the government of the Federation of Malaya and the British government agreed that they would work towards a formal agreement for the transfer of the North Borneo territory (and Singapore) to the Federation of Malaysia. No such formal agreement was ever reached. Yet, Britain proceeded to include Sabah among the territories it transferred to Malaysia. 

On December 29, 1962, the Philippines and the United Kingdom announced an agreement to hold talks on the Philippine claim. Thus, from January 28 to February 1, 1963 the first Ministerial Conference on the Claims was held in London with then Vice President Emmanuel Pelaez heading the RP panel. 

Did not the Philippines object to the formation of the Federation of Malaysia on September 16, 1963 which included Sabah? Yes, it did, together with Indonesia which, in turn, was claiming Sarawak. Thus, then Malaysian Prime Minister Tunku Abdul Rahman, Indonesian President Soekarno and Philippine President Diosdado Macapagal met in Manila in August 1963.  The Manila Accord of 1963 was signed where Malaysia agreed that the inclusion of Sabah in its Federation would not prejudice the Philippine claim. Malaysia acknowledged the right of the Philippines to pursue its claim in accordance with international laws and the United Nations principles of pacific settlement of disputes. 

From February 5 to 10, 1964, the first round of talks between Malaysia, the Philippines and Indonesia (known as the Maphilindo talks) was held in Bangkok. Around the same time, President Macapagal and the Malaysian Prime Minister met in Phnom Penh. The Tunku agreed to elevate the claim to the International Court of Justice and encouraged the Philippines to submit a memorandum detailing the basis of its claims. The foreign affairs ministers of the Maphilindo states held a second round of talks from March 5 to 6, 1964. Then in June 1964 the Philippines gave to Malaysia its memorandum, “Philippine Claim to North Borneo Vol. 1” as suggested by the Malaysian Prime Minister. 

What happened in the Maphilindo talks in Bangkok? The talks failed because Malaysia unilaterally rejected the Philippine claim to Sabah and then terminated the talks. In so doing, it arrogated unto itself the power of a judge while being a contending party in the dispute. The talks were held supposedly to agree on what modes of settlement, as provided in the Manila Accord of 1963, were acceptable to both governments. 

How significant are the meetings in London and in Bangkok to the Philippine claim? The London foreign ministers’ meeting was significant in that it gave the Philippine claim the status of a legitimate international dispute. On the other hand, the Maphilindo agreement to meet in Bangkok pursuant to the Manila Accord was significant in that it contained a reservation agreed upon by the Philippines, Malaysia and Indonesia that the formation of Malaysia would not prejudice the unresolved Philippine claim over North Borneo (Sabah). All three countries also agreed to settle the dispute by peaceful means such as arbitration. In effect, therefore, Malaysia accepted the existence of the legitimacy of the Philippine claim to Sabah. 

What is the effect of Malaysia’s unilateral termination of the Maphilindo talks in Bangkok? Malaysia violated several solemn agreements. One of them is the Manila Accord. Another is the agreement between the Philippine President and the Malaysian Prime Minister in Phnom Penh that the two countries would discuss the “best way of settling the claim, not precluding reference to the International Court of Justice.” Still another was the exchange of Communique between the two countries where both essentially agreed to discuss the best way to settle the claim. 

Should the Sultanate of Sulu be blamed for taking proactive action in reclaiming Sabah? The manner the Sultanate asserted its claim may not have been the proper and legal way but this writer will not go as far as blaming the Sultanate. The historical records speak for themselves. Why the government is taking the stance of an un-involved observer is beyond comprehension. When the sovereignty and dominion over the territory was transferred to the Philippine government by the Sultanate in 1962–which the government accepted as shown in its many overt acts–the government took on the responsibility of reclaiming Sabah and protecting Filipinos who initiate non-violent actions to revive the Philippine claim.

PLEASE SHARE -- THIS IS VERY IMPORTANT: ON SABAH PROPRIETARY RIGHTS (DIFFERENT FROM SOVEREIGNTY RIGHTS WHICH BELONG TO THE REPUBLIC): THE SULTANATE OF SULU HAS NINE LEGALLY RECOGNISED ROYAL HEIRS...  

Their intra-family bickering must not affect whatever the Republic's position is on its claim to Sabah which, by law -- by virtue of Republic Act 5446, is Philippine territory.

Government must step back and avoid such confusing remarks because the principle of Government support for their struggle must be for the Sultanate of Sulu as a body and for the people of Sulu and not for an individual. 

Unless government and the public accept the principle that there are nine legal heirs representing the Sultanate of Sulu, Government itself risks defeating the Republic's own legal cause in the future. 

Government must not confuse the people of this country and instead must use the Philippine law to Government's advantage in trying to resolve the Sabah crisis which has now claimed several dozens dead in the hands of a foreign government's maniacal troops.

Malaysian writer calls Najib to task for not honouring 1963 Manila Accord

One of the provisions in the 1963 Manila Accord: to settle the Sabah case in the international court but Malaysia has now decided they did not want to honour the UN treaty. Without Malaysia's agreement, the Philippines cannot push the ICJ to arbitrate.

Paragraph 12 of the Manila Accord:

"The Philippines made it clear that its position on the inclusion of North Borneo in the Federation of Malaysia is subject to the final outcome of the Philippine claim to North Borneo. The Ministers took note of the Philippine claim and the right of the Philippines to continue to pursue it in accordance with international law and the principle of the pacific settlement of disputes. They agreed that the inclusion of North Borneo in the Federation of Malaysia would not prejudice either the claim or any right thereunder. Moreover, in the context of their close association, the three countries agreed to exert their best endeavours to bring the claim to a just and expeditious solution by peaceful means, such as negotiation, conciliation, arbitration, or judicial settlement as well as other peaceful means of the parties' own choice, in conformity with the Charter of the United Nations and the Bandung Declara tion."

Note this: "They agreed that the inclusion of North Borneo in the Federation of Malaysia would not prejudice either the claim or any right thereunder."

But the recent pronouncements of Najib contradicted what Malaysia had agreed upon with PH in the Manila Accord; he said that Kuala Lumpur will never never let go of Sabah. It is contrary to and is a violation of that agreement which is a UN treaty.

In an article by Vidal Yudin Weil for the Free Malaysia Today on dated March 9, 2013, the writer called Najib to task after Najib's pronouncement:

Yesterday, Najib made the following statement at a press conference in Lahad Datu: “The question of Sabah within Malaysia should not be disputed by anyone. Let not anyone underestimate Malaysia’s commitment to have Sabah within Malaysia forever. No one can dispute this, from within and outside the country. We will uphold the principle and fact of Sabah within Malaysia absolutely”. 

And insisted that Najib was wrong:

Najib is wrong in making unilateral claims that Sabah belongs to Malaysia when historical legal documents and agreements may indicate otherwise.

The writer also continued to enumerate the salient points in that Manila Accord:

It was undoubtedly stated from the above provisions of the Manila Accord and joint statement that:

• the inclusion of Sabah into the formation of Malaysia is subject to the Philippines claim; and

• the Philippines’ claim on Sabah must be settled in the International Court of Justice (ICJ) run by the United Nations.

And with implaccable logic, stated:

Therefore, until such time when the ICJ has decided, Malaysia does not have absolute ownership of Sabah.

As Vidal called Najib to task, it became clear to me that there just might still be honourable people among the Malaysians:

By refusing to honour the Manila Accord and backtracking on the joint statement, has Najib not figuratively slapped the Philippines and Indonesia which were signatories to the historic documents? 

Internationally, is Najib not telling the whole world, especially foreign investors, that what Malaysia agrees and signs at any time may not be fulfilled or respected at Malaysia’s whims and fancies?

Obviously, Najib was emboldened to issue his offending pronouncements and to not honour the Manila Accord because our own president's inaction and playing spokesman to Najib served as signals to Malaysia that the Philippines wouldn't do anything about the claim. 

In that context, President Aquino is equally if not more guilty than Najib for waylaying the Manila Accord which is tantamount to his dismissing his Constitutional obligations. President Aquino's actions during the Sabah stand-off have clearly have emboldened Najib to overtly violate the Manila Accord which is a UN treaty. 

By choosing to side with Najib and Malaysia rather than with the Sultanate of Sulu, the president is also guilty of violating the Republic's contractual obligation vis-à-vis the Sultanate of Sulu which was to prosecute the Sabah claim. 

The President must realise that his refusal to push for the recognition of the 1963 Manila Accord during this critical period is tantamount to giving Najib and the Kuala Lumpur government the right to rape and plunder the Philippines. I really see no other way to put it.

Najib is wrong in making unilateral claims that Sabah belongs to Malaysia when historical legal documents and agreements may indicate otherwise. 

According to the Manila Accord signed on July 31, 1963 and registered in the United Nations as document No. 8029, then Malayan deputy prime minister Abdul Razak Hussein (late father of the present Prime Minister Najib Tun Razak) met up with foreign minister Dr Subandrio of Indonesia, and vice-president Emmanuel Pelaez of the Philippines in Manila for five days from June 7 to 11, 1963, to discuss about the status of Sabah. 

Consequently, it was agreed in writing by former Malayan prime minister Tunku Abdul Rahman together with president Soekarno of Indonesia and president Diosdado Macapagal of the Philippines in paragraph 12 thereof: 

“The Philippines made it clear that its position on the inclusion of North Borneo in the Federation of Malaysia is subject to the final outcome of the Philippines’ claim to North Borneo. The ministers took note of the Philippines’ claim and the right of the Philippines to continue to pursue it in accordance with international law and the principle of the pacific settlement of disputes. They agreed that the inclusion of North Borneo in the Federation of Malaysia would not prejudice either the claim or any right thereunder. Moreover, in the context of their close association, the three countries agreed to exert their best endeavours to bring the claim to a just and expeditious solution by peaceful means, such as negotiation, conciliation, arbitration, or judicial settlement as well as other peaceful means of the parties’ own choice, in conformity with the Charter of the United Nations and the Bandung Declaration.” 

Subsequently on Aug 5, 1963 in a joint statement released to international media, the same also agreed in writing under paragraph 8 thereof: 

“In accordance with paragraph 12 of the Manila Accord, the three Heads of Government decided to request the British Government to agree to seek a just and expeditious solution to the dispute between the British Government and the Philippines Government concerning Sabah (North Borneo) by means of negotiation, conciliation and arbitration, judicial settlement, or other peaceful means of the parties’ own choice in conformity with the Charter of the United Nations. The three Heads of Government take cognizance of the position regarding the Philippines claim to Sabah (North Borneo) after the establishment of the Federation of Malaysia as provided under paragraph 12 of the Manila Accord, that is, that the inclusion of Sabah (North Borneo) in the Federation of Malaysia does not prejudice either the claim or any right thereunder.” 

It was undoubtedly stated from the above provisions of the Manila Accord and joint statement that: 

• the inclusion of Sabah into the formation of Malaysia is subject to the Philippines claim; and

• the Philippines’ claim on Sabah must be settled in the International Court of Justice (ICJ) run by the United Nations. 

Therefore, until such time when the ICJ has decided, Malaysia does not have absolute ownership of Sabah. 

Yesterday, Najib made the following statement at a press conference in Lahad Datu:

Now, with the involvement of the two late former prime ministers of Malaysia – Tunku Abdul Rahman and Abdul Razak Hussein – in the Manila Accord and joint statement which contained straightforward and unambiguous stipulations, the question that begged to be answered now is: why did Najib lie to the whole nation without even blinking his eyes? 

By refusing to honour the Manila Accord and backtracking on the joint statement, has Najib not figuratively slapped the Philippines and Indonesia which were signatories to the historic documents? 

Internationally, is Najib not telling the whole world, especially foreign investors, that what Malaysia agrees and signs at any time may not be fulfilled or respected at Malaysia’s whims and fancies? 

How are Malaysians going to face anyone overseas when our own prime minister has made us the butt of jokes and the laughing stock of the world? 

Effectively, he has also slapped each and every Malaysian who has an ounce of dignity.
