All about the genuine Sabah Claim Society

ATTENTION! This blog is the genuine Sabah Claim Society.

We are Philippine patriots who have grouped together from around the world and who created the Sabah Claim Society group originally on Facebook on 15 July 2011 and counted close to 6,000 members.

But on 5 October 2011 our group on Facebook was traitorously hijacked by two people we had invited to join us as group admins but who, we learned later on, had been hired to sabotage our patriotic group by a group of sinister individuals sporting fake European sounding nobility titles and other spurious Tausug/Sulu titles ['bestowed' and indiscriminately distributed on Facebook] and organized by a combined team of charlatans namely a datu (sporting a fake sultan title) and the latter's handler who is conveniently sporting an absolutely fake 'princely' title as well.

Please be warned that the said group of individuals, we believe, are in fact con artists out to "claim" Sabah for "get rich quick" reasons and are not genuine Philippine patriots. Their motive, we have discovered, is to be able to convince Malaysians that they are genuine Sulu royalty and pro-Philippine Sabah claim supporters in order to extract from Malaysia (which has control of Sabah today) a premium for letting go of the Sabah claim.

Sultan of Sulu: No to PH consular office in Sabah

Sultan of Sulu: No to PH consular office in Sabah

THE Sultanate of Sulu and North Borneo reiterated its rejection of proposals made by Malaysians for the Philippine government to open a consular office in Sabah.
Apparently agitated by the reports that the Aquino administration has decided to open a consular office in Sabah, Sultan Esmail Kiram 2nd, the reigning Sultan of Sulu and North Borneo, expressed serious concern.
The Sultan’s wazir, not quite his prime minister but his policy adviser, former Gov. Almarin Centi Tillah of Tawi-Tawi, relayed these concerns to The Manila Times’ Publisher-Editor Rene Bas.
“We have every reason to believe that the plan while being denied publicly by Aquino officials, was agreed upon in secret between President Aquino and Prime Minister Najib Razak,” Al Tillah said.
“This is a betrayal not only of the Sultanate of Sulu and North Borneo but also of the Republic of the Philippines. It is against Philippine national interest to virtually abandon the claim to Sabah by opening a consular office there and thereby show the world that the Philippine government accepts Malaysian sovereignty over Sabah,” he added.
In a separate event also on Monday, the Sultanate’s spokesman, Abhraham Idjurani, told Manila Times reporter Ritchie Horario of the Sultanate’s rejection of the plans “of the government to establish a Philippine consular office in Sabah.
Idjurani said saying that this is tantamount to surrendering Philippine sovereignty over Sabah to Malaysia.
“The Sultanate of Sulu is vehemently opposing any move by MalacaƱang to put up a Consular Office in the disputed territory,” Idjirani said.
The establishment of a consular office in the disputed territory was raised during the recent visit of President Benigno Aquino 3rd in Malaysia.
In case the plan pushes through, Idjirani said, Aquino would be the first Philippine President to start with “a wrong policy to waste a national legacy and as part of the Muslim contribution to nation building.”
“He has forgotten that any effort to diminish this legacy is a betrayal to the Filipino Great Cause,” he added.
He added that Aquino must remind Malaysia that it should adhere to the rule of law embodied in the 1963 Manila Accord.
North Borneo is that part of Sabah that is the sovereign territory of the reigning Sultans of Sulu and North Borneo.
The present Sultan, Esmail Kiram II, as his predecessors did, gladly accepts the fact of his being a Filipino citizen. Therefore, any lands and seas in his realm is part of the Republic of the Philippines.
That Sabah is Philippine territory is affirmed by the transfer by the then reigning Sultan of Sulu and North Borneo, Muhammad Esmail Kiram I, “of full sovereignty, title and dominion” over Sabah to the Philippines on September 12, 1962. The President of the Philippines then was Diosdado Macapagal.
Legal documents show that Sabah was leased by the Sultan of Sulu and North Borneo to agents of the British North Borneo Company. The UK then handed over the lease to the leaders of Malaya when they, with British support, were forming the Federation of Malaysia.
The Malaysian government maintains that Sabah belongs to it and Sabah is a state of the federation. The Philippines disputes that claim.
During President Aquino’s visit to Malaysia last week, Malaysian media once again played up proposals that the Philippines open a consular office in Sabah.
Problems of Filipino “migrants” in Sabah—Filipino Muslims carrying Philippine passports—have been cited by Malaysians as the reason there should be a consulate.
The way the news reached the Philippines, it seemed as if President Aquino and his administration have agreed to these proposals.
That is not true. President Aquino himself has stated that he did not want the Sabah dispute to be discussed but that Prime Minister Najib Razak did.
The Malaysian PM suggested the establishment of a hotline over the Sabah dispute. The hotline would be between the Philippine and Malaysian security authorities. The Malaysian PM himself told journalists this detail.

Jamalul Kiram III dies, daughter says sultan wants Pinoys to continue fight for Sabah

Jamalul Kiram III dies, daughter says sultan wants Pinoys to continue fight for Sabah
By: InterAksyon.com
October 20, 2013 8:20 AM

UPDATE 4 - 9:14 a.m.) MANILA, Philippines - Sulu Sultan Jamalul Kiram III passed away Sunday morning at the Philippine Heart Center (PHC) in Quezon City, the sultan's daughter Princess Jacel Kiram, told dzMM radio.
Kiram, who fought to reclaim Sabah from Malaysia, died at 4:42 a.m. He was 75.
He was supposed to undergo dialysis but his blood pressure dropped drastically prompting his family to rush the sultan to the PHC where he died due to multiple organ failure, according to Princess Jacel.
"Iniwanan n'ya tayo [He left us] with something to move on. We have to continue fighting for the Filipino people," his daughter said.
"Ang gusto n'ya tayo na lang ho ang magpatuloy for the Sabah case [What he wants is for us to pursue the Sabah case]," added Kiram's daughter.
Princess Jacel said that before he died, her father said that, "You have to be strong dahil meron pa tayong misyon sa buhay. Kailangang maibalik kung ano ang dapat na maibalik sa atin You have to be strong because we still have a mission in life. What needs to be returned should be returned to us] ."
She said Kiram also always told his family that, "Everything happens because the Almighty allowed it to happen."
Kiram's remains were brought to his residence at Maharlika Village in Taguig City
Princess Jacel said their family would like to bury the sultan in Maimbung, Sulu within 24 hours.
In February this year,  Kiram sent about 400 of his followers to Tanduao village in Sabah's remote coastal town of Lahad Datu to reclaim the territory.
Kiram said he was prompted to send his people to Sabah after the Philippine government left them out of the framework agreement signed in October, which only catered to the interest of the Moro Islamic Liberation Front (MILF).
It was Malaysia, which took over Sabah in 1963, that brokered the peace talks between the Philippine government and the MILF.
While the MILF respects the Kiram family's claim to Sabah and won't stand in the way of that claim, it "will not revive the claim," according to Khaled Musa, deputy chairperson of the MILF's committee on information.
Kiram, who ran but lost in the 2007 senatorial elections, was the acknowledged leader of the Sultanate of Sulu and North Borneo. The sultanate based in Southern Philippines once controlled North Borneo, which is now known as Sabah.
The sultanate acquired Sabah as a prize for helping the Sultan of Brunei against his enemies.
According to the sultante, it did not relinquish its sovereignty over Sabah and only leased the territory to the Briitish North Borneo Company starting in 1878.
Pajak, the keyword in the 1878 pact
The keyword in the 1878 agreement between the Kiram family and Gustavo von de Overbeck of the Briitish North Borneo Company was pajak. The Kirams maintain that pajak means lease. But Malaysian authorities define pajak as sale.
The lease continued until the independence and formation of the Malaysian federation in 1963, which included Sabah.
Because of Sabah's inclusion, the Philippine government during the presidency of Diosdado Macapagal, broke diplomatic relations with Malaysia.
It was during Macapagal's term when then reigning Sultan of Sulu, Muhammad Esmail E. Kiram I, ceded to the Philippine government the full sovereignty, title, and dominion of Sabah to the Republic of the Philippines. This gave the Philippine government the full authority to pursue its claim to Sabah in international courts.
But starting in 1989, succeeding administrations put the Sabah claim on the back burner and instead decided to pursue economic and security relations with Malaysia.
P70,000 for 7 million hectares
Up to now, the heirs of the sultanate receive rental money for Sabah from the Malaysian government.
Sabah’s total land area is 7.36 million hectares or almost one-fourth of the Philippines, which is 30 million hectares.
Annually, the Malaysian government pays the heirs of the Sultanate of Sulu, 5,300 Malaysian ringgit currently equivalent to P70,000. If pajak is defined as rent, it means that Malaysia’s annual rent of Sabah is only .009 centavos per hectare.
According to Kiram, the rent they receive only proves that the sultante owns Sabah
"Why should we leave our own home? In fact, they are paying rent (to us)," Kiram earlier told reporters in Manila
"Our followers will stay in Lahad Datu. Nobody will be sent to the Philippines. Sabah is our home," he added.

Sulu ‘volunteers’ plan Sabah incursions

Sulu ‘volunteers’ plan Sabah incursions

The Sulu Sultanate on Sunday  said  it is sending more “volunteer” fighters to Sabah from Mindanao to reassert its territorial claim over it and to protect the Filipinos there who are being rounded up by Malaysian police.
Abraham Idjirani, spokesman of Sulu Sultan Jamalul Kiram III, said groups of Bangsa Suluk volunteers were preparing to sail to Sabah and join the 1,600-strong Royal Security Forces of the sultanate led by Kiram’s brother, Raja Muda Agbimuddin Kiram.
“They will be going to Sabah because of the un-Islamic rounding up of innocent civilians by the Malaysian security forces,” Idjirani said from Kiram’s residence in Taguig City.
“They feel it is their patriotic duty to protect their countrymen there and to show the world that Sabah is their homeland.”
Asked how many fighters were sailing to Sabah, Idjirani said they had no idea yet but the fighters would be going there quietly in waves or groups to elude the Malaysian and Philippine naval cordons.
Once in Sabah, they would be consolidating forces and communicating with Agbimuddin, who remains in Sabah since sailing there with 200 men in February.
“They are now driven by their belief that Malaysia does not own Sabah,” Idjirani said.
He said the volunteers would come from Sulu, Tawi-Tawi, Basilan and Zamboanga.
“Our leaders told us that these Bangsa Suluks have been itching to go to Sabah because they are angry over the Malaysians’ treatment of the Filipino residents of Sabah,” Idjirani said.
He said  some of the Sabah-bound volunteers would be armed, with many of them experienced in battle, although they would not be going to Sabah to wage war.

Fuad Kiram is not sultan of Sulu; his only legal, royal title is Datu Fuad A. Kiram

FUAD KIRAM SIGNED THE 'UNITY' AGREEMENT WITH HIS REAL TITLE, DATU!

The recent Sabah stand-off brought out some truth that many of us did not know or expect. First, we did not know the relation between the Cojuangcos (PNOY's family) and Malaysia dating back to the time of then Senator Ninoy Aquino (PNOY's father). Then we discovered to our dismay that our president would rather go back on his sworn duty to protect this country and its people just to protect his KKK's business interests and to protect his parents' legacy, right or wrong.

It is disheartening to know that our president stands by while our people are being hunted down, tortured and killed for asserting their lawful right. Listening to our president colluding with the enemy and echoing Malaysia's Razak Najib's sentiments are not only disheartening but also disconcerting. Added to the Sulu Sultanate's dilemma is the disunity of the Kiram heirs.

One of them, the infamous Datu Fuad has been defrauding people in and out of Facebook under the wing of his Con-Artist handler, the Master Puppeteer, Omar "FAKE" Kiram who is not even a Muslim by birth but who is an Ilonggo and is never a Kiram. Omar is peddler of FAKE or knock-off designer bags and accessories who met Datu Fuad by chance. Being a Con-Artist, Omar saw an opportunity for a money-making scheme using a Royal title albeit FAKE. Read the attached file I previously wrote with compelling proof to back up my claim.

Fast forward to the recent development brought on by the stand-off. The Kiram heirs decided to unite and rally behind the REAL Sultan of Sulu who was proclaimed Sultan by the Ruma Bechara in a public ceremony in Sulu unlike the UNDIGNIFIED self-proclamation of Datu Fuad in a basketball court in Taguig. Sultan Mohammad Jamalul Kiram III (SJK) is the only one recognized as the true Sultan by both the Philippine and Malaysian government when Malaysia first attempted to buy off Sabah from the Sulu Sultanate during the administration of Pres. Cory Aquino and then Pres. Fidel Ramos up to the administration of Pres Gloria Macapagal-Arroyo.

The administration of PNOY may not recognize SJK because he claimed ignorance of the issue at pinag-aaralan pa daw niya. I wonder why Sec. Lila De Lima's findings of the Sultanate were not even posted. Could it be that it only proves the Sulu Sultanate's case and it is a humiliating truth for PNOY? The rest of the Kiram heirs have signed that settlement agreement to drop the claim on Sabah EXCEPT for Sultan Jamalul who could not with his heart and soul, sell the legacy of his people. He declined the money and this is where we are now.

The attached document showed that Datu Fuad signed with his TRUE AND ONLY legal Royal title and that is as a DATU. FUAD ALSO ASKED THE HEIRS FOR MONEY BECAUSE ACCORDING TO HIM HE IS HEAVILY INDEBTED TO HIS FINANCIERS. Check out his signature and see for yourself. THIS IS NOT A FABRICATION like what his handler Omar has been posting in their fraudulent website where pictures are photo ops (like the ones with Nur Misuari who happened to oblige to a meeting request by Fuad and Omar) and all other documents FABRICATED to defraud people. I will post some more of the documents soon.
The documents I posted on the files I wrote are AUTHENTIC and these are not fabricated! This is why I challenged the FAKE Royals to sue me to see who is lying. But of course, they threatened but they never do because they know that they will be UNMASKED and their money-making scheme will be stopped. In the court of law, what matters is what you can prove.

I DON'T CLAIM ANYTHING UNLESS I CAN PROVE IT! So for the charlatans out there and the attack dogs sent to intimidate me and any of us, what we say about you is ALL TRUE. NEMO NOS IMPUNE LACESSIT!

North Borneo (Sabah), British North Borneo Company and the British Crown colonisation

UNDERSTANDING THE SABAH PROBLEM

One factor that is essential in the comprehension of the Sabah problem is to understand that Sabah was only officially colonised by the British Crown in 1946 which means that UNTIL THEN, North Borneo (Sabah) WAS PART of the Sultanate of Sulu although leased.

Picture on the left is the court of directors of BNBCC.
Seated from left to right :

1) Mr Harrington G. Forbes, Secretary
2) Sir Charles J. Jessel, Bart., Vice Chairman
3) Mr Richard B. Martin, M.P., Chairman
4) Mr William C. Cowie, Managing Director
5) Mr Edward Dent
Note that before that year, North Borneo (Sabah) was managed by the British North Borneo Company under a lease signed between the representatives of the company, Messrs Overbeck and Dent in 1878. The British Crown had not during that time officially colonised North Borneo (Sabah.)

Despite British Crown's colonisation of Sabah from 1946 until 1963, it is my opinion that Sabah's sovereignty, although compromised by the British colonisation, still legally belonged to the Sultanate of Sulu. However, we all know that the Sultanate of Sulu ceded full sovereignty of Sabah to the Philippine Republic on 12 Septemeber 1962 while it was still a colony of Britain.

On 31st August 1963, Britain granted Sabah (whose sovereignty rights had been ceded the year before to the Republic of the Phlippines) its independence

Sixteen days after Britain granted Sabah its independence in 1963, and despite PH protests, it was annexed to a new federation in the making called MALAYSIA instead of returning it either to the Sultanate of Sulu or to the Republic of the Philippines which had already inherited sovereignty rights over Sabah from the Sultanate by virtue of the transfer on 12 September 1962.

In 1968, while Malaysia had taken de facto control of Sabah, the Republic of the Philippines enacted a series of laws related to our baselines and one of these laws is the Republic Act 5446 which acknowledges title and dominion over Sabah, thus by PH law, Sabah is Philippine territory. RA 5446 is still in vigour.

As Law Professor Isagani Cruz says:

"President Noynoy faces an insoluble dilemma. If he believes that Sabah is part of the Philippines, he has to defend Sabah because Malaysia is attacking it. If he does not believe that Sabah is part of the Philippines, he opens himself up to impeachment, because Philippine law says that Sabah is part of the Philippines and he is sworn to uphold Philippine law. Talking of a conspiracy does not solve the problem; in fact, it is irrelevant if there is or there is no conspiracy. The dilemma has to do simply with his stand on Sabah itself."
To my mind, the Sultanate of Sulu, and by extension the royal heirs, is irrelevant in the PH claim because Sabah is already PH territory by PH law. The Philippine Republic, however, has contractual obligations which it signed when it accepted from the Sultanate of Sulu the full transfer of sovereignty rights in 1962 and one of these contractual obligations is to prosecute the claim and in so doing, help the Sultante of Sulu's proprietary rights to be recognised. So we cannot actually take it against the Sultanate for feeling doubly rebuffed. It is the Philippine Republic's contractual obligation to do it and the Government has been remiss in its obligations.

NB: The relevant point in the Sabah question is THE NINE SULTANATE HEIRS and not whoever the sultan is. The Philippine Government must not use the Kirams' intra-family bickering as an excuse NOT to perform the Republic's contractual obligation.

Nota Bene: OTHER VERY IMPORTANT NOTE THAT EVERYONE MUST KNOW: When the Sabah lease was signed 134 years ago -- on the 22nd of January 1878, between the Sultanate of Sulu & Sabah and two foreign businessmen, the Sultanate ensured that their rights to Sabah ownership were protected with this all encompassing moral and legal clause clearly spelled out in the lease contract, to wit (Restrictive clause):

"...but the rights and powers hereby leased shall not be transferred to any nation, or a company of other nationality, without the consent of Their Majesties Government."

Sabah's proprietary rights involve nine legally recognised Sultanate of Sulu heirs

Sultan of Sulu, Sultan Jamalul Kiram II (picture taken around 1936)

ON SABAH PROPRIETARY RIGHTS (DIFFERENT FROM SOVEREIGNTY RIGHTS WHICH BELONG TO THE REPUBLIC): THE SULTANATE OF SULU HAS NINE LEGALLY RECOGNISED ROYAL HEIRS... And their intra-family bickering must not affect whatever the Republic's position on its claim to Sabah which, by law - by virtue of Republic Act 5446, is Philippine territory.

The nine royal heirs must be allowed to decide among thelselves who their sultan is... we, the non-sultanate member citizens of the Republic, must leave them alone to sort out their own family problem.

Government must therefore abstain from putting more fat in the already confusing problem by remarking "We don't even know who the legitimate sultan is!" Government must step back and avoid such confusing remarks because the principle of Government support for their struggle must be for the Sultanate of Sulu as a body.

Unless government and the public come to terms with the principle that there are nine legal heirs representing the Sultanate of Sulu, Government itself will be defeating the Republic's own legal cause. Government must not cofuse the people of this country and instead must use the Philippine law to Government's advantage in trying to resolve the Sabah crisis which has now claimed several dozens dead in the hands of a foreign government's maniacal troops.

RAJAMUDA MUEDZUL T. KIRAM DENOUNCES UNCLE DATU FUAD KIRAM FOR TRYING TO USURP SULTANATE OF SULU THRONE

Problems facing the Sultanate of Sulu are mounting because of the smear campaign tactics by Omar Maniquis against the other members of the Kiram family in order to promote Datu Fuad A. Kiram as the reigning sultan of Sulu despite evidences that point to the fact that Datu Fuad is far from being the successor to the sultanate of Sulu throne.

Based on our interviews with many legitimate members of the Royal Kiram family, we have come to the conclusion that the motive of Omar Maniquis, who has been using the name of "Omar Kiram", for promoting discord in the Sultanate of Sulu is purely monetary.

Because we believe that the Philippine national claim to Sabah is contingent upon the unity of the sultanate of Sulu, we continue to gather facts for all may know. To defend the Philippine Sabah claim effectively, it is essential to unmask the charlatans from among those claiming to be members of the Royal Kiram family.

Rajamuda Muedzul T. Kiram's website carries the following post denouncing his uncle Datu Fuad Kiram for trying to usurp the Sulu sultanate throne:

*Photo shows Rajamuda Muedzul-lail T Kiram (left) in better times with his uncle Datu Fuad Kiram (shown right in photo) whom he appointed regent of sabah but who has since declared himself Sultan of Sulu and Sabah despite overwhelming evidences that he cannot be a legitimate pretender to the throne of Sulu and Sabah. Fuad Kiram has been excommunicated by Sulu Ruma Bechara following his self-declaration as Sultan of Sulu.

On Datu Fuad Kiram, the phoney sultan of Sulu and the now officially proclaimed liar

Claims by Datu Fuad Kiram and his handler, a certain Omar Maniquiz who is purporting to be a prince of the Tausugs, that Fuad Kiram has been recognized by the Provincial Government of Sulu as the legitimate sultan of Sulu can not be more untrue.

Fuad Kiram maintains in various fora that he has been recognized the legitimate sultan of Sulu by the Governor of Sulu no less. But researches have proven that Mr Fuad Kiram has lied. The official website of the Province of Sulu does not list the name of Fuad Kiram as sultan of Sulu but lists all the names of the different members of the Sultanate who had been officially recognized the legitimate sultans of Sulu and Sabah since the beginning.

Datu Fuad Kiram's pretensions and claims are therefore based on lies. The claim by Fuad Kiram and his handler, an individual going by the name of Omar Kiram who is himself shamelessly sporting a fake title, that Governor Tan has recognized Fuad Kiram as the legitimate sultan of Sulu has been discovered to be a myth and can only be considered a product of the over fertile imagination of a charlatan. See for yourself:
